Portable long service leave under the Scheme is funded by employer levies. Most registered employers comply with their obligations by paying in full and on time. The Authority will take necessary steps to recover levies if they are not paid in full or on time.
There are serious consequences for employers who fail to engage with the Authority. One example is a community services employer with unpaid levies of $35,000 who ignored multiple attempts of contact. The Authority filed legal proceedings. The employer chose not to engage with the court process. As a result, it is now in liquidation and can no longer operate.
Another example is an employer active in both the security and contract cleaning industries with unpaid levies of $26,500 across both industries. The employer initially avoided engaging with the Authority. The Authority filed legal proceedings. The employer then paid its levies in full including legal costs, avoiding further legal action.
The Authority will continue to take necessary steps to ensure employers meet their obligations and remain compliant. Employers who consistently fail to make payments on time may face legal action, including criminal penalties.
